Step-Parent Adoption in Gwinnett County and the Metro Atlanta Area

 

Gwinnett County step-parent adoption cases have moved faster through the adoption process since the new Georgia adoption law went into effect.  The new law was passed in 2018 and had not been updated since 1990.  There are new forms and requirements under the new law for all types of adoptions including step-parent adoptions.

If you want to adopt your spouse's child and the child's other parent agrees to the adoption then a number of documents will need to be prepared and filed including the petition for adoption, verification form, surrender of parental rights form, acknowledgment of surrender of rights, parental consent form, Mother's affidavit, petitioner's representative affidavit, and the birth family background Information for Child form (known as Form 419).  Since you will be the petitioner you will need to go through a fingerprinting process and criminal background check.  The judge may also appoint a home study agent under certain circumstances. 

Gwinnett County Superior Court handles adoption petitions that are filed in Gwinnett County.  The Gwinnett County Superior Court clerk's office has an adoption clerk that is responsible for processing the filing of all new Gwinnett County adoption cases.
